1. Acceptance of Terms

By accessing or using BizwellSolution's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Services

BizwellSolution provides:

  • Cloud engineering services (AWS, Azure, GCP)
  • Cybersecurity services and monitoring
  • Information technology support and management
  • Domain registration and DNS management
  • Landing page builder and hosting
  • Project management and collaboration tools
  • Support ticketing and live chat

3. Account Registration

3.1 Account Creation

You must create an account to access our services. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

3.3 Account Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services.

4. Subscription Plans and Billing

4.1 Plan Selection

We offer multiple subscription tiers (Starter, Growth, Enterprise) with varying features and service hours. You may upgrade or downgrade your plan at any time.

4.2 Payment Terms

  • Subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • Payment is processed securely through Stripe
  • You authorize us to charge your payment method for all fees
  • Failure to pay may result in service suspension or termination

4.3 Price Changes

We reserve the right to modify pricing with 30 days' notice. Price changes will not affect your current billing cycle.

5. Service Usage and Restrictions

5.1 Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Use our services for illegal or fraudulent activities
  • Resell or redistribute our services without authorization

5.2 Service Hours

Each plan includes a specified number of support hours per month. Unused hours do not roll over. Additional hours may be purchased at our standard hourly rate.

6. Domain Services

6.1 Domain Registration

Domain registrations are subject to the policies of the respective domain registrar and ICANN. You are responsible for maintaining accurate WHOIS information.

6.2 Domain Renewals

You are responsible for renewing domains before expiration. We will send renewal reminders but are not liable for expired domains.

7. Intellectual Property

7.1 Our Property

All content, features, and functionality of our services are owned by BizwellSolution and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of content you upload to our services. By uploading content, you grant us a license to use, store, and display it as necessary to provide our services.

8. Service Level Agreement (SLA)

Our SLA commitments vary by plan tier. See our separate SLA document for detailed uptime guarantees, response times, and remedies.

9. Data and Privacy

Your use of our services is also governed by our Privacy Policy. We implement security measures to protect your data but cannot guarantee absolute security.

10. Termination

10.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

10.2 By Us

We may suspend or terminate your account for violation of these terms, non-payment, or illegal activity. We will provide notice when possible.

10.3 Effect of Termination

Upon termination, your access to services will cease. You may request a data export within 30 days. We will delete your data according to our retention policy.

11. Disclaimers and Limitations

11.1 Warranty Disclaimer

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.

11.2 Limitation of Liability

To the maximum extent permitted by law, BizwellSolution shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless BizwellSolution from any claims, damages, or expenses arising from your use of our services or violation of these terms.

13. Dispute Resolution

13.1 Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law provisions.

13.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through our services. Continued use after changes constitutes acceptance.
